    QUIKSILVER RETAIL TROPICAL ESCAPE 2008

    TERMS AND CONDITIONS OF ENTRY
    1.    Information on how to enter and prizes form part of these Terms and Conditions. Participation in the ‘Quiksilver Retail Tropical Escape 2008’ promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.  
    2.    The Promotion commences at 9am (AEST) on September 22, 2008 and ends at 5pm (AEST) on November 16, 2008 (“Promotion Period”).  
    3.    Entrants of the Promotion that are under fourteen (14) years of age must have a parent or guardian’s permission before providing personal information.  Employees of the Promoter and their respective subsidiaries, affiliates, officers, agents and the immediate family members of each are ineligible to enter.  Proof of identity must be furnished upon request.
    4.    To qualify for entry, entrants must, during the Promotion Period, purchase a Quiksilver or Roxy Surfboard, Wetsuit, Watch or Eyewear item from a Quiksilver or Roxy retail store in Australia or New Zealand, excluding Outlet stores and sale items, and complete a valid entry form (“Entrants”).  Only one entry form per transaction will be accepted.  Completed entry forms must include Entrant’s name, date of birth, phone number and email address (“Entries”).  Note, a lay by does not constitute a valid purchase unless the customer pays all monies outstanding on the lay by item within the Promotion Period.  Return of a purchase (other than under a non-excludable statutory warranty) will invalidate the Entry for that purchase.
    5.    The draw will take place at 27 Baines Crescent, Torquay 3228 Victoria at 10am AEST on December 15, 2008.  The first valid entry randomly drawn (“Winner”) will win a trip to Sumatra, Indonesia, as outlined below.
    Prize
    The prize comprises:
         2 return economy airfares from Australia or New Zealand to the Telo Islands, via Padang, Indonesia;
         10 nights standard (twin-share) accommodation for 2 people at the Latitude Zero Resort, Sumatra, Indonesia (“Resort”) and all meals and non-alcoholic beverages while at the Resort;
         Transfers to/from Telo Island Airport to the Resort, via boat.
    (“Prize”)
    The total value of the Prize is up to AUD$12,000.  The Promoter takes no responsibility for any variation in the Prize value. 
    Conditions
         The Prize is subject to availability and conditions.
         If the event that the Winner is under eighteen (18) years of age, the Prize will be awarded to the Winner’s parent/s or legal guardian. 
         The Prize may be taken any time during 2009 (subject to availability), but must be booked by June 30, 2009.
         The airline ticket must be issued by June 30, 2009 (valid one year from date of issue). 
         No changes can be made to travel arrangements once tickets have been issued.
         Travel restrictions and blackout dates apply. Prize cannot be taken during peak periods or school holidays.
         No frequent flyer/airline reward program points can be earned on the flight.
         If the Winner is an Australian resident, the flight shall be from the closest state capital to the winner’s primary residence.  If the Winner is a New Zealand resident the flight shall be from Auckland.  The Prize does not cover regional flights or any flights/accommodation or other costs associated with travel to/from the Winner’s place of residence to point of departure.  Any costs associated with returning to the Winner’s place of residence and all other ancillary costs are at the expense of the Winner.  
         If the Winner is a non resident of Australia or New Zealand, the flight must depart from the Australian or New Zealand city nominated by the Winner.  The Prize does not cover international flights or any flights/accommodation or other costs associated with travel to/from the Winner’s country of residence to point of departure in Australia or New Zealand.  Any costs associated with returning to the Winner’s country of residence and all other ancillary costs are at the expense of the Winner.  
         The Prize does not include travel insurance, passports, visas, spending money, meals (outside the Resort), medical expenses, laundry, telephone calls, transfers, taxes not included in the price of the ticket, ground transportation and any other costs of a personal nature not stated.
         Compliance with any health or other government requirements is the responsibility of the Winner and their nominated travel companion. Without limiting the above, entry onto any country and satisfying any customs or related requirements is the full responsibility of the Winner and their nominated travel companion. Prize travel is subject to fare rules and the General Conditions of Carriage of the relevant carrier. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and trade.
         Any extension to the duration of the Prize is at the Winner’s sole expense and subject to availability at the time of booking. 
    6.    The Winner will be notified in writing within 24 hours of being drawn and their name will be published in the public notices section of the Australian Newspaper on December 17, 2008.  All reasonable efforts will be taken to contact the Winner.  If the Prize remains unclaimed, a redraw will take place at 27 Baines Crescent, Torquay 3228 Victoria at 10am AEST on March 16, 2009.  In the event of a redraw, the Winner will be advertised in the public notices section of the Australian Newspaper on March 18, 2009.
    7.    As a condition of entry, all Entrants agree to be bound by the decisions of the Promoter, which shall be final and binding in all matters relating to the Promotion. No correspondence will be entered in to.  Incomplete, indecipherable, or illegible Entries will be deemed invalid.  The Promoter is not responsible for lost Entries.
    8.    The Prize is non-transferable or exchangeable and cannot be taken as cash.  If the Prize (or part of any the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute that Prize (or that part of that Prize) with a prize to the equal value and/or specification. 
    9.    The Winner (and their travel companion) must hold a current passport with at least 12 months validity as at the time of travel and satisfy any Visa requirements.  The Winner (and their travel companion) must also satisfy the Promoter as to their health and fitness for travel.  The Winner (and their travel companion) must complete any and all legal documents requested by the Promoter and return them to The Promoter within five (5) working days of receipt of such documents.  Noncompliance with these Terms and Conditions will result in disqualification of the Winner and an alternate winner will be drawn from remaining Entries.
    10.    The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity and age) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the
