WIN A TRIP TO THE 2007 QUIKSILVER PRO FRANCE
TERMS AND CONDITIONS

Information on how to enter and prizes form part of these Terms and Conditions. Participation in the ‘Win a Trip to the 2007 Quiksilver Pro France’ promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.   
To enter, customers (“Entrants”) must spend $100 or more in one transaction in a Quiksilver or Roxy retail store in Australia or New Zealand, excluding Outlet stores, during the Promotion Period to receive an entry form.  Entrants must then complete a valid entry form which includes their name, phone number, store location and receipt number relevant to their purchase and attach their answer in 200 words or less to the question “Which surfer do you think will win the 2007 Quiksilver Pro Australia or the 2007 Roxy Pro Australia and why?” (“Entries” or “Entry”).    Australian Entrants must send their Entries to Quiksilver Pro Promotion, 42 Balgowlah Road, Balgowlah NSW 2093 Australia. New Zealand Entrants must send their Entries to Quiksilver Pro Promotion, 151 Queen Street, Auckland, New Zealand. Only one Entry per transaction will be accepted. 
Entry to the Promotion is only open to residents of Australia and New Zealand.  Entrants under 14 years of age must have a parent or guardian’s permission before providing personal information.  Employees of the Promoter and their respective subsidiaries, affiliates, officers, agents and the immediate family members of each are ineligible to enter. Proof of identity must be furnished upon request.
Entrants must retain their original Quicksilver or Roxy store purchase receipt(s) for all Entries as proof of purchase. Failure to produce the proof of purchase for all Entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant’s Entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
As a condition of entry, all Entrants agree to be bound by the decisions of the Promoter, which shall be final and binding in all matters relating to the Promotion. No correspondence will be entered in to. This is a game of skill and chance plays no part in determining the winners.  Each Entry will be individually judged based on literary and creative merit of the answer provided to the question. Incomplete, indecipherable, or illegible Entries will be deemed invalid.
The Promotion will commence at 9am local time on 9th February 2007 and close on 5th March 2007 (“Promotion Period”).   Entries must be received by last mail 9th March 2007. 
The judging will take place at 10am (Australian EDST) on 4th April 2007 at the 42 Balgowlah Road, Balgowlah NSW 2093, Australia (“Promoter’s Head Office”), and the best valid Entry as determined by the judges will win a trip for 2 to the 2007 Quiksilver Pro France (“Event”), comprising:
2 return economy airfares from Australia or New Zealand to Paris, France, departing 20th September 2007 and returning 27th September 2007 (“Trip Period”), and return economy flights and transfers from Paris to Hossegor. If the winner is an Australian resident, the flight shall be from the closest state capital to the Winner’s primary residence.  If the winner is a New Zealand resident the flight shall be from Auckland.  The Travel Prize does not cover regional flights or any flights/accommodation or other costs associated with travel to/from the winner’s place of residence to point of departure.  Any costs associated with returning to the winner’s place of residence and all other ancillary costs are at the expense of the winner.  
6 nights standard accommodation for 2 people at the Hotel Mercedes, Hossegor from 21st September 2007 to 27th September 2007 (“Accommodation”);
Breakfast and lunch at the Event site on the days on which the Event is held during the Trip Period (if any);
Daily transfers to and from the Accommodation to the Event; the main contest breaks being La Nord, Hossegor and Les Estagnots, Seignosse; (“Travel Prize”)
The total value of the Travel Prize is up to AUD$10,000. 
The Entrant acknowledges that the window period for the Event is from 21st September, 2007 to 1st October 2007 (“Event Window”) and the Event may be held at any time during the Event Window.  The Promoter does not guarantee that the Event will be held during the Trip Period and the Entrant acknowledges that the Event (including the Final) may not be held during the Trip Period and may be partially held before and/or after the Trip Period.  The Promoter may, in its discretion, amend the itinerary, provided the Trip Period falls within the Event Window.
The Travel Prize does not include additional transfers, spending money, medical expenses, travel insurance, visas, items of a personal nature, additional meals and beverages, airport or port taxes, government taxes or levies, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the Prize other than those specified. These costs are the responsibility of the winner of the Travel Prize. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at the hotel to cover all incidentals they may incur including their stay at the hotel.  The winner must arrange travel insurance for the winner and his/her travel companion and provide proof of this to the Promoter upon request. Travel Prize is subject to the standard terms and conditions of individual prize and service providers. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash. Any extension to the duration of the Travel Prize is at the winner’s sole expense and subject to availability at the time of booking.
The next best 19 valid Entries as determined by the judges will each win a 2007 Quiksilver Pro Australia or 2007 Roxy Pro Australia event merchandise pack (including, but not limited to a tee shirt, cap and stickers) to the retail value of AUD$200 (“Runner Up Prizes”).
The total prize pool is up to AUD$13,800. The Travel Prize and Runner Up Prizes are non-transferable or exchangeable and cannot be taken as cash. 
The winners of the Travel Prize and Runner Up Prizes (“Prize Winners”) will be notified by telephone within 24 hours of their selection and by mail within 7 days of their selection.  The Prize Winners will also be announced on the promoter’s websites ( HYPERLINK "http://www.quiksilver.com" www.quiksilver.com and  HYPERLINK "http://www.roxy.com" www.roxy.com).
If for any reason a Prize Winner does not take an element of a prize at the time stipulated by the Promoter, then that prize or that element of that prize will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute that prize (or that part of that prize) with a prize to the equal value and/or specification.
The Travel Prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction.
Prize Winners consent to the Promoter using the Entrant's name, likeness, image and/or voice in the event they are a Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration or further reference for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
All Entries submitted become the property of the Promoter. Entries will not be returned to any Entrant. As a condition of entering into this promotion, each Entrant licenses the Promoter to use their Entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes without further notice or remuneration. Each Entrant warrants to the Promoter that each Entry submitted is an original literary work of the Entrant that does not infringe the rights of any third party.  The Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Entrants consent to any use of their Entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
The winner of the Travel Prize must hold a current passport with at least 12 months validity as at the time of travel to the Event and satisfy any Visa requirements.  The winner of the Travel Prize may be required to provide evidence of Australian or New Zealand residency. The winner of the Travel Prize must also satisfy the Promoter as to their health and fitness for travel.
The winner of the Travel Prize must complete any and all legal documents requested by the Promoter and return them to The Promoter within five (5) working days of receipt of such documents.  Noncompliance with these Terms and Conditions will result in disqualification of the winner and an alternate winner will be selected from remaining runner up Entries. 
 The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If the winner of the Travel Prize is under the age of 18 years, the Travel Prize will be awarded to their parent or legal guardian and the winner must be accompanied by their parent or legal guardian.  The winner or the person who collects the Travel Prize on behalf of the winner will be required to show their driver’s license to the Promoter or its agent prior to the Travel Prize being handed over.  
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Quicksilver Pro France event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a Prize Winner or Entrant; or (g) any prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All Entries become the property of the Promoter.

Above photos are of 9 year old Daniel and father Michael. Daniel's a little grom who became interested in surfing after meeting Robert August & Robert Weaver (two surf legends from the endless summer movies). When Dan isn’t dreaming of an endless summer he’ll be playing for his soccer team Adelaide City.
As for dad when he’s not chasing Dan around he has a hardware store in Adelaide to keep himself busy, whilst always dreaming of getting back to the beach.
"On the trip we would like to take my wife Angela, Myself & Daniel my Number 1 artist. Happy to pay for Daniels air fair but we can work that out with the travel agent". Both he & Angela are on a mission to meet Kelly Slater.

Also a big mention must go to the all the runners up, unfortunately you guys didn't win but came extremely close, thanks again and you have a $200 clothing package coming your way.
